These Terms and Conditions ("Terms") govern your use of alloffroad.com.au (the "Site"), operated by Stephan Fischer, trading as AllOffRoad ("AllOffRoad", "we", "us", "our"). By accessing or using the Site you agree to these Terms. If you do not agree, you must not use the Site.

1. About AllOffRoad

AllOffRoad is an independent Australian 4WD and adventure-travel publication operated as a sole trader by Stephan Fischer. The Site publishes trip reports, product reviews, technical articles, videos and other content relating to four-wheel driving, remote-area travel and outdoor adventure.

2. Content Is Informational Only

All material on the Site — including trip reports, route descriptions, vehicle advice, recovery techniques, product reviews and travel information — is provided for general information and entertainment purposes only. It is based on the personal experience and opinion of Stephan Fischer.

Four-wheel driving and remote-area travel are inherently risky activities. Conditions change, tracks shift, vehicles and equipment behave differently in different circumstances, and what works for one driver on one day may not work for another. You must make your own assessment of any route, technique, vehicle setup or piece of equipment before you rely on it. Where appropriate, obtain formal training, seek qualified advice, and always carry adequate safety and recovery equipment for the trip you are attempting.

You use the information on the Site entirely at your own risk.

3. Intellectual Property

All content published on the Site — including text, photographs, videos, graphics, logos, page layouts and the arrangement of the Site itself — is the property of Stephan Fischer / AllOffRoad or is used with permission, and is protected by Australian and international copyright law.

You may:

  • View, download and print single copies of Site content for your own personal, non-commercial use.
  • Share links to Site pages on social media and in other non-commercial contexts.
  • Quote short extracts (a reasonable paragraph or two) for the purposes of review, discussion or news reporting, provided you clearly attribute AllOffRoad and link back to the original page.

You may not:

  • Reproduce, republish, syndicate, adapt or translate substantial portions of Site content without our prior written permission.
  • Use Site content (including photos and video stills) in any commercial, promotional or advertising context.
  • Use automated tools to scrape, harvest or mirror content from the Site.
  • Use Site content to train, fine-tune or evaluate artificial-intelligence or machine-learning systems without our prior written permission.
  • Remove or alter any copyright, trademark or attribution notices on Site content.

The "AllOffRoad" name and logo are trade marks used by Stephan Fischer. You must not use them in any way that suggests endorsement, affiliation or sponsorship without our prior written consent.

4. Product Reviews and Editorial Independence

AllOffRoad is an independent publication. Our reviews are based on real-world field use, not on sponsored talking points.

  • Products reviewed may be purchased by AllOffRoad, supplied free of charge, or loaned for a test period. In every case, the decision about whether — and how — to review a product rests entirely with AllOffRoad.
  • We do not accept payment in exchange for a positive review, and we do not allow brands, manufacturers or PR agencies to approve, edit or veto review content before publication.
  • Where a review is the result of a brand partnership or similar commercial arrangement, this is disclosed in the content itself.

All opinions expressed in reviews are the honest views of the reviewer at the time of publication, based on the testing carried out.

5. Affiliate Links and Third-Party Products

Some links on the Site are affiliate links. This means that if you click through to a third-party retailer or platform and make a purchase, AllOffRoad may receive a small commission at no additional cost to you. Affiliate commissions help support the production of the content on the Site but do not influence our editorial opinions.

Where the Site links to third-party websites, products or services, we do so for informational purposes. We are not responsible for the content, accuracy, pricing, availability, shipping, warranties, returns or conduct of any third party, and any transaction you enter into with a third party is solely between you and that third party.

6. Newsletter and Contact Form

If you subscribe to our newsletter, you agree to receive email updates from AllOffRoad at the address you provided. You can unsubscribe at any time using the link in every newsletter email.

By submitting the contact form or otherwise corresponding with us, you agree that we may respond using the contact details you provide. Please do not send us confidential, legally privileged or sensitive personal information through the Site's forms.

7. User Conduct

When using the Site, you must not:

  • Use the Site for any unlawful purpose or in breach of any applicable law.
  • Submit false, defamatory, abusive, harassing, obscene or misleading content via any form or communication channel.
  • Attempt to gain unauthorised access to any part of the Site, its hosting infrastructure, or any related systems or networks.
  • Introduce viruses, malware, or any other harmful code or material.
  • Interfere with, disrupt or place an unreasonable load on the Site or its servers.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

We reserve the right, at our sole discretion, to remove any user-submitted content and to refuse service to any person at any time.

8. External Links

The Site links to external websites, including YouTube, Patreon, Buy Me a Coffee, social media platforms, brand and manufacturer sites, and affiliate partners. We do not control those websites, we do not endorse their content except where expressly stated, and we are not responsible for their availability or conduct. Your use of any external website is governed by the terms of that site.

9. Availability of the Site

We aim to keep the Site available, but we do not guarantee uninterrupted access. We may, at any time and without notice, change, suspend or discontinue all or part of the Site, remove content, or change these Terms.

10. Disclaimers and Warranties

To the maximum extent permitted by law, the Site and all content on it are provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to warranties of accuracy, completeness, fitness for a particular purpose, merchantability or non-infringement.

We do not warrant that the Site will be error-free, secure, free from viruses or uninterrupted.

11. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you may have under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) or any other applicable law that cannot lawfully be excluded. Where a consumer guarantee applies and cannot be excluded, our liability for breach is limited, to the extent permitted by law, to re-supplying the relevant service or paying the cost of having the service re-supplied.

12. Limitation of Liability

To the maximum extent permitted by law, AllOffRoad, Stephan Fischer, and any contributors to the Site, will not be liable to you for any loss or damage — whether direct, indirect, incidental, consequential, special or exemplary — arising from or in connection with:

  • Your use of, or reliance on, any content on the Site;
  • Any 4WD trip, route, technique, recovery, vehicle setup or purchasing decision you make based on information on the Site;
  • Any error, omission or inaccuracy in Site content;
  • Any unavailability of the Site; or
  • Any conduct or content of a third party linked to, or referenced by, the Site.

This clause applies whether the claim is framed in contract, tort (including negligence), statute or otherwise.

13. Indemnity

You agree to indemnify and hold harmless AllOffRoad and Stephan Fischer against any claim, loss, damage, cost or expense (including reasonable legal costs) arising out of your breach of these Terms, your misuse of the Site, or your infringement of any third-party rights.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. You and we submit to the exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them, and the Federal Court of Australia, in respect of any dispute arising out of or in connection with these Terms or your use of the Site.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date above shows when they were most recently revised. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms. If you do not agree with the changes, you must stop using the Site.

16. Severability

If any part of these Terms is found by a court of competent jurisdiction to be invalid, unlawful or unenforceable, that part will be severed from these Terms and the remainder will continue in full force and effect.
